    none of this is relevant in copyright law. the only thing that matters is who published it first and who is then using that copyrighted work for profit without first having gotten permission of the owner.

OpenAI admitted that Rowlong’s works (among many others) were used for training chatGPT.

    be more of a burden on smaller artists vs. large studios with lawyers-in-tow.

    also irrelevant, unless you’re arguing that, because it’s too difficult for small artists to defend their copyrighted work, they should just shut up and deal with it. currently, there is no legal precedent as to whether this is or is not copyright infringement, which is what a lawsuit like this is intended to set.     I’ll have to disagree with you on that second point. I really enjoyed the SNW musical episode. I got major The Magicians feels from it, and I thought the music was great! However, some of the individual songs were… kinds weird, and, as for it being a Trek episodes, I wasn’t a fan in that regard. I really hope this isn’t a sign the show its getting CW-ified.

    SNW is like if you took TOS and miked in some DIS and LD. I kinda like it, but they really need to dial back the character drama and focus more on the sci-fi. and not “boom ‘splode!” sci-fi, but the “solve complex science problems with professionalism and teamwork” sci-fi and “confront weird moral/ethical conundra in space” sci-fi. ”Among the Lotus Eaters”, ’’Under the Cloak of War’’, ’’Ad Astra Per Aspera’' were excellent episodes in that regard because they actually focused on the crew doing Star Trek things, interacting with the world around them, solving problems, etc. rather than just their dumb interpersonal bullshit.

    I mean, with ’’Tomorrow and Tomorrow and Tomorrow”, we get the opportunity for a cool time-travel episode, but noooo, we have to have it be mostly about La’an’s crush on Kirk and how mesmerizingly charming he is, even in alternate-timeline form. And the result? Possibly the most interesting thing about the episode, Kahn Noonien Singh as a kid, is reduced to, maaaaybe a 30 second scene where he’s like, “please don’t murder me!,” and she’s like, “k, bye!” as the writers hand-wave away one of the franchise’s biggest timeline inconsistencies it’s had since the IRL 1990s did not devolve into the Eugenics Wars as TOS predicted it would. C’mon, you guys had the whole episode to address this, and you wasted it with all that cutesy bullshit with La’an and Kirk? What crap.

    that’s not exactly what’s in dispute— the prodcut that LLMs produce. That would probably be ruled as a derivative work under the DMCA’s “Fair Use” clause, and, therefore, public domain.

    the issue at hand is that the company accessed the copyrighted material without paying for it and is now using that training to earn more money without fair compensation.

    these language models or even proper AI can't create original creative works the way a human can. The best it can do it create a pastiche or composition that simulates originality but is really just a jumble of recycled ideas that it’s been trained on. There’s a fair argument to be made that the owners of the copyrights of those pesos works are entitled to fair compensation, especially since AI is a tool used by a company to churn out profit off the work of others.
